Welcome to TicketBoard. These Terms of Service (“Terms”) govern your use of TicketBoard’s services, available at https://ticketboard.cc/ (the “Service”). TicketBoard is operated by H2GB, a company registered in France (“we,” “us,” or “our”).

By accessing or using TicketBoard, you agree to be bound by these Terms. If you’re using TicketBoard on behalf of an organization, you’re agreeing to these Terms on behalf of that organization, and you represent that you have the authority to do so. Please read these Terms carefully before using our Service.

1. Acceptance of Terms

By creating an account, accessing our website, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you (“you,” “your,” or “User”) and TicketBoard. You must be at least 18 years old and capable of forming a binding contract to use this Service.

If you are using the Service on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

2. Account Registration

To use TicketBoard, you must create an account by providing accurate, current, and complete information, including a valid email address.

You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree to notify us immediately of any unauthorized use of your account or any other security breach.

You are solely responsible for all activities that occur under your account, whether or not authorized by you. We are not liable for any loss or damage arising from your failure to protect your account credentials.

You may not share your account with others, transfer your account to another person, or use another person’s account without permission.

You agree to provide accurate information and to update your account information promptly if it changes. We reserve the right to suspend or terminate accounts with incomplete, false, or outdated information.

Each account connects to a Zendesk instance using the credentials you provide. You are responsible for ensuring those credentials are authorized for the Zendesk data you intend to access.

3. Zendesk Data Access & Permissions

TicketBoard functions by connecting to your Zendesk account using API tokens that you provide. By providing these credentials, you grant TicketBoard permission to access your Zendesk data for the purpose of generating analytics and dashboards.

You represent and warrant that you have the legal right and authority to grant TicketBoard access to your Zendesk account and the data contained within it.

TicketBoard will access only the data necessary to provide the Service, including but not limited to ticket information, user data, organization data, and metrics related to your support operations.

Your Zendesk API credentials are encrypted at rest and stored securely. We implement industry-standard security measures to protect your credentials from unauthorized access.

You can revoke TicketBoard’s access to your Zendesk account at any time by disconnecting your Zendesk integration within the Service or by revoking the API token directly in your Zendesk settings.

TicketBoard operates as a data processor with respect to the Zendesk data you provide. You remain the data controller and retain all ownership rights to your Zendesk data.

We do not sell, rent, or share your Zendesk data with third parties for their marketing purposes.

4. Data Handling & Privacy

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

TicketBoard implements tenant isolation, meaning your data is logically separated from other customers’ data and cannot be accessed by other users of the Service.

We process personal data in accordance with the GDPR and other applicable data protection laws. As we are based in France and serve EU customers, we adhere to EU data protection standards.

We retain your data for as long as your account is active or as needed to provide the Service. If you terminate your account, we will delete or anonymize your data within 30 days, unless we are required to retain it for legal or regulatory purposes.

5. Subscription, Billing & Cancellation

TicketBoard offers both free and paid subscription plans. The features, limitations, and pricing of each plan are described on our website and are subject to change with reasonable notice.

Payment is processed through third-party payment processors. You agree to provide accurate and complete payment information and authorize us to charge your payment method for all fees incurred.

If you cancel a paid subscription, you will retain access to paid features until the end of your current billing period, after which your account will revert to the free plan (if available) or be deactivated.

Certain taxes (such as VAT or sales tax) may apply to your subscription based on your location.

6. Intellectual Property

The Service, including its software, design, text, graphics, logos, and other content (excluding your data), is owned by TicketBoard and is protected by intellectual property laws.

You retain all ownership rights to the data you provide to TicketBoard, including your Zendesk data. By using the Service, you grant us a limited license to process, store, and display your data solely for the purpose of providing the Service to you.

7. Limitation of Liability

The Service is provided on an “as is” and “as available” basis without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

TicketBoard, its affiliates, and its service providers shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

Our total liability to you for all claims arising out of or related to these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or EUR 100 if you have not paid us any fees, whichever is greater.

8. Termination

You may terminate your account at any time by canceling your subscription and disconnecting your Zendesk integration. You may also contact us to request account deletion.

We reserve the right to suspend or terminate your account and access to the Service at any time if you violate these Terms or applicable laws, or if we decide to discontinue the Service with reasonable notice.

9. Governing Law

These Terms and your use of the Service are governed by the laws of France, without regard to its conflict of laws principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in France.

10. Changes to Terms

We may update these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our website at least 30 days before changes take effect.
